OZschwitz: Accountant, arrested for jaywalking during APEC summit

A SYDNEY accountant, challenged for jaywalking during the APEC summit and later arrested and charged, had been agitated and aggressive and had sworn at police, a court heard yesterday.

Gregory McLeay had allegedly crossed Pitt Street twice at the back of the Sultan of Brunei's motorcade, while the street was blocked to all traffic, Downing Centre Local Court was told.

But police had no intention of charging him with jaywalking, they told the court. They spoke to him and asked for his particulars, when McLeay allegedly said: "I have no respect for any police officer, you are all idiots."

Turning to Detective Senior Constable Bill Heather, who had first challenged him while he was walking across the street, McLeay allegedly said: "And you are a short idiot. APEC is a joke."

It was only when he allegedly assaulted another officer that he was arrested and restrained by three or four officers - footage of which was captured by a camera crew filming nearby.

The footage, played to the court, shows officers yelling: "Release your arms" and "Stop resisting". McLeay, who was lying face down on the ground, can be heard saying: "I am trying to protect my glasses."

He was then handcuffed, taken away and charged with assaulting an officer, resisting an officer and failing to comply with a direction when told not to cross the road.

Detective Heather said he first spoke to McLeay after he had crossed Pitt Street, but the man had been agitated and aggressive from the beginning and said: "Bloody hell, I work in this street. I'm just going to lunch."

He said McLeay then turned around and crossed the road again. Detective Heather challenged him, grabbed his upper arm, led him across the street and sought to explain the restrictions to him, but McLeay struggled.

"I didn't know the man. I didn't know what his intentions were. I didn't know what he was going to do," Detective Heather told the court.

Sergeant Daryl Shaw had then joined the men and asked McLeay for his identification, but soon McLeay allegedly stepped quickly towards him and said: "Hurry up."

Detective Heather said he stepped between the men and placed his hand on McLeay's chest before McLeay allegedly pushed him back. The officer told the court he then pushed McLeay and told him he was under arrest.

On the footage, McLeay has his hands in his pockets.

Detective Heather said McLeay had asked for the men's names in an aggressive tone, was red in the face and shuffling about. "He's a lot taller than me. I felt like his actions were intimidating to me."
