Alleged domestic terrorist Kyle Rittenhouse is looking to sue Joe Biden over libel for allegedly suggesting that the shooter is a white supremacist.

According to Fox News, an attorney representing the Kenosha shooter has announced that he plans to file a lawsuit against Biden, and his campaign, for allegedly suggested that the teen is a white supremacist in a video the Democratic presidential nominee shared online.

Rittenhouse’s attorney, Lin Wood, told Fox News on Wednesday that he made plans to sue Biden on his client’s behalf only hours after Biden posted the 50-second clip. In the post, Biden writes, “There’s no other way to put it: the President of the United States refused to disavow white supremacists on the debate stage last night.” The video shows a montage of different clips of white supremacists and alt-right white nationalist groups. The tweet gained more than 48,000 retweets and 148,000 likes.

Biden’s alleged suggestion comes after Trump refused to denounce violence, white right-wing nationalists, and white supremacy. Instead, Trump called for the #ProudBoys, a far-right, white nationalist and neo-fascist, male-only organization, to “stand back and stand by” during the first 2020 U.S. Presidential election. When the debate’s moderator Chris Wallace asked Trump if he would condemn white supremacy, he named white nationalist-led domestic terrorist attacks that have been seen in Kenosha, Wisconsin, and Portland, Oregon.

Video footage captured Rittenhouse, an Illinois native, walking into a #BlackLivesMatter protests heavily armed. The night ended with Rittenhouse fatally shooting two people and injuring a third person after a person attempted to take his gun away. Rittenhouse’s legal team claims that the teen was only defending himself when he fired his weapon on August 25. Wood also claims that Biden “falsely accused a 17-year old boy & prejudiced Kyle’s legal rights.”

While Anti-Defamation League has looked into Rittenhouse’s social media activity and allegedly found no details about him being connected to any extremist group, BLM protesters say militia groups “collaborated, planned, orchestrated” an assault on protesters August 25, according to CNN.
