Now’s a great time for licensing reform

The coronavirus pandemic has, among other things, forced individuals, businesses and governments alike to rethink how they conduct themselves.
Governments across the country, including the federal government, quickly realized that one of the necessary things to do was to waive rules and regulations that impeded the healthcare system from working with the sort of dynamism the pandemic called for. One lesson we hope politicians and bureaucrats can take to heart is the realization that very often rules and regulations do more to stifle innovation and economic activity than anything else.
In that same spirit, we hope that California’s lawmakers in Sacramento can someday find the time to reconsider one major regulatory area in need of rethinking: occupational licensing.
California has one of the most extensive and onerous occupational licensing systems in the country, requiring workers in a litany of professions to get government licensing to earn a living. According to a nationwide Institute for Justice study of the licensing rules for 102 lower-wage jobs, California requires licensure for 76 of them. This includes many jobs few other states bother to license, while also setting higher bars for entry than other states do.
Evidence of benefits from licensing often don’t exist, though there’s mounting evidence of the harms of extensive licensing requirements. The Institute for Justice has calculated the statewide impact of licensing laws to manifest in the form of hundreds of nearly 200,000 job losses.
Meanwhile, the Archbridge Institute has published research indicating that licensing is associated with declines in economic mobility.
As the nation tries to find its footing, and as people look for work, repealing unnecessary barriers to work makes more sense than ever.
Florida Gov. Ron DeSantis recently signed legislation abolishing or easing requirements for dozens of occupations including hair braiding and interior designing.
California should follow suit. This year, the Legislature has already rejected proposals making it easier for nurses and physical therapists licensed out of state to work here, and has generally been hostile to licensing reform. We hope that changes soon.
