| A federal judge in California has halted the sale of high-capacity magazines in the state, just a week after he ruled that the state's ban on them was unconstitutional. U.S. District Court Judge Roger T. Benitez, who previously served on the California Superior Court and was appointed to the Southern District of California by George W. Bush in 2004, stopped any further sales of magazines capable of holding more than 10 rounds until the 9th U.S. Circuit Court of Appeals considers the next steps. In a win for California Attorney General Xavier Becerra, who disagreed with Benitez's initial ruling and sought the stay, California residents are prohibited from manufacturing, importing, or engaging in any kind of transaction involving the high-capacity magazines as of 5 p.m. Friday.
Last week, Benitez issued an 80-page decision striking down the ban, saying that the measure encroaches on fundamental constitutional liberties granted to California residents by the U.S. constitution. “California’s law prohibiting acquisition and possession of magazines able to hold any more than 10 rounds places a severe restriction on the core right of self-defense of the home such that it amounts to a destruction of the right and is unconstitutional under any level of scrutiny,” Benitez wrote last week.
