We’ve got some bad news and good news on asset forfeiture and the 10th Amendment. This week, Attorney General Jeff Sessions announced renewed federal support for an asset forfeiture program that helps local police do an end-run around state-level restrictions. Taking people’s property without a criminal conviction is robbery. Period. But, on top of it, the approach from Sessions & Co. is to help it happen even when states try to limit it. Again, the AG is showing total disrespect for the 10th Amendment. While there have been a number of good-intentioned organizations asking people to call on congress to put a stop to this, you probably know as well as I do that federal politicians simply cannot be trusted to stop federal power. You only need to look at what’s happening with Obamacare for proof. That’s the bad news. Here’s the good news. While some federal programs are logistically very difficult to nullify, the federal asset forfeiture program is actually one of the easiest.
