The New Hampshire State House voted down a bill to make women’s “reckless disregard” for the potential offensive nature of breast and nipple exposure a misdemeanor on Wednesday. “Free the Nipple” protests have been launched against such measures in the state and nationwide.
The New Hampshire chapter of the American Civil Liberties Union wrote up a report on the failed bill, addressing its violation of free speech rights, its excessive punishment in labeling repeat offenders as sex offenders, and its impractical forcing of police officers to determine somebody’s gender.
“In a state with an average temperature of only 46 degrees, the risk of rampant nudity seems rather low,” the ACLU report added.
