NSW Premier Mike Baird is bending the Rule of Law far more than Uri Geller did to cutlery. In fact,  he is throwing the kitchen sink, the knives, forks, spoons and the Rule of Law out the parliamentary windows.

While his federal counterpart, Prime Minister Tony Abbott, implored the Indonesian President to follow the Rule of Law, his NSW colleague is reversing hundreds of years of common law and the careful exercise of power according to an agreed set of standards. When the Independent Commission Against Corruption, represented by Jeremy Kirk, SC, and Scott Robertson faced off in the High Court against Margaret Cunneen  with her brilliant lawyers David Jackson, QC, and Arthur Moses, SC, they lost hands down. They had lost in the NSW Court of Appeal.

What distinguishes democracies and countries with a Rule of Law from random dictatorships is the fact that litigants and citizens can come to rely on the consistency of the judicial system and its exercise of the Rule of Law.
