An Adelaide council has been accused of "bureaucratic madness" for insisting the owner of a local fish and chip shop remove an open sign from his window.

The proprietor of the shop at Hazelwood Park received two notices from Burnside Council that warned he needed to remove the flashing electronic open sign, which they considered to be a distraction, or he faced a fine of up to $20,000.

Independent MLC John Darley said it lacked common sense and was a case of "mindless red tape".

"The definition of signs is not clear," he said.
