OZschwitz: Gypsy Jokers lose bid to keep fortification

Motorcycle club The Gypsy Jokers have failed in a bid to overturn a decision to keep excessive fortifications at a Perth clubhouse.

The Gypsy Jokers Motorcycle Club have fought long and hard to keep fortifications at its Maddington clubhouse.

But Justice Peter Blaxell today upheld a police and Corruption and Crime Commission decision to maintain a removal notice issued to the club in the Supreme Court of Western Australia.

The club was issued with a fortification removal notice by the Commissioner of Police after it was approved by the Corruption and Crime Commission in May, 2004. They have seven days to remove the fortifications, or police will do it for them.

The clubhouse comprised a clubhouse within a walled compound which former Police Commissioner Mel Hay said were heavily fortified and frequented by people who were reasonably suspected to be involved in organised crime.

"The fortifications and in particular, the front concrete wall, the solid entry gates and the controlled entry system could reasonably be regarded as 'excessive' in the sense that they were unnecessary from the point of view of deterring uninvited entry by burglars and thieves but were a significant impediment to uninvited entry by police officers," Justice Blaxell said.

The club's four-year battle ended to keep the fortifications ended up in the High Court before it was rejected and sent back to the Supreme Court to be reviewed.

At the time the fortification removal notice was given to the Gypsy Jokers at their Maddington clubhouse had a perimeter 10cm thick wall up to 2.8m in height, a 2.1m, high steel framed vehicle access gate, surveillance cameras, security bars and window grilles.

A hidden room at the premises led to an area where ammunition was seized during a 2001 raid.

The Gypsy Jokers argued the case they were trying to protect their property in a high crime area.
