Some of Australia's top clothing labels are employing migrant workers for up to 15 hours a day in sweatshops while paying them as little as $5 an hour, according to court documents lodged by the textile union.

The Textile Clothing and Footwear Union alleges that 23 fashion labels are running unregulated supply chains that exploit low-paid workers - predominantly female migrants - by paying wages well below the legal minimum and failing to provide basic employment entitlements, including superannuation, annual leave, workers' compensation and sick leave.

Labels owned by companies named in the action filed with the Federal Circuit Court include Driza-Bone, Anna Thomas, Mariana Hardwick, Arthur Galan, Viktoria and Woods, Fella Hamilton, Digbys, Nicholas, Kamikaze and Cubec.

The union will argue that factories in the companies' supply chains are paying workers by the garment, which in some cases amounts to $5 to $6 an hour.
