| Radio station 2Day FM has failed in an attempt to stymie an investigation by the communications watchdog into the royal prank call incident.
The decision paves the way for a finding that the station broke the law over the incident and the imposition of tough penalties, ranging from large fines to stringent conditions on its broadcast licence.
Federal Court Judge Richard Edmonds on Thursday dismissed an application by 2Day FM to permanently restrain the Australian Communications and Media Authority from finding that it committed a criminal offence or breached the conditions of its broadcasting licence. The application was a response to a scathing interim report by ACMA, which found that 2Day FM had breached regulations by recording and broadcasting the prank call that preceded the suicide of British nurse Jacintha Saldanha.
