| Federal prosecutors believe a Wisconsin child pornography suspect will voluntarily decrypt his hard drives to enable prosecutors to level more charges against him.
“They are out of their mind. We do not intend to decrypt,” Robin Shellow, the defendant’s attorney, said in a telephone interview today.
The government’s decryption proposal, made in a court filing Wednesday, is part of an ongoing legal flap surrounding the effectiveness of encryption and the right to be free from compelled self-incrimination.
The case concerns defendant Jeffrey Feldman, a Wisconsin computer scientist whose suburban Milwaukee apartment was raided in January after authorities suspected him of downloading child pornography from the e-Donkey file-sharing network. Prosecutors sought a court order demanding the Rockwell Automation computer scientist decrypt his drives to aid the government’s prosecution. Feldman refused, citing the Fifth Amendment, and a novel, ongoing legal fight ensued.
