| THREE prison officers who were stood down following the death in custody of a man being held on traffic offences will keep their jobs and will sue the NSW Attorney-General over comments he made about the case.
The NSW Industrial Relations Commission has ordered officers David Pearcey, Matthew Barnett and Richard Woelfl not be sacked by the NSW Department of Corrective Services over the death.
They will now sue the Attorney-General, Greg Smith, and the ABC for defamation over comments and the coverage of the matter.
Prisoner Ian Klum died in hospital in June, 2010, from injuries he sustained while in Grafton jail, having been sentenced to six months for repeated driving offences. Advertisement
The allegations against the three officers were that they displayed a ''disregard for Mr Klum'' after he complained he had been assaulted in his cell.
