I always feel nervous when High Court decisions come down in favour of asylum seekers and refugees. Why? Because when our politicians react to these decisions by changing laws or pushing people outside Australia's legal system, justice and fairness can become more elusive ideals.
When the High Court decided in 2010 that procedural fairness should be granted to asylum seekers arriving in Australia's excised territories, former immigration minister Philip Ruddock described the ruling as ''diabolical'' and claimed it would lead to a rapid increase in boat arrivals.
