THE beaming smile was perhaps a sign of relief as much as elation.

After a marathon conciliation session, the former David Jones publicist Kristy Fraser-Kirk is understood to have accepted less than $1 million to settle her sexual harassment case against David Jones and its former chief executive Mark McInnes.

The settlement is significantly less than the $37 million she had demanded and is believed to be close to the $850,000 offered by David Jones recently.

The 27-year-old wouldn't comment as she left the talks last night, but it was soon revealed that the main terms had been agreed.

''We're very proud,'' Ms Fraser-Kirk's mother, Sally, said. ''Relieved as ever,'' her father, Alex, said.

Lawyers for both parties worked into the night to hammer out the technical details.

It was a dramatic end to one of the most high-profile sexual harassment cases in Australian legal history.

Ms Fraser-Kirk had accused Mr McInnes of making unwanted advances towards her at two David Jones functions and that he sent inappropriate text messages to her. She has also alleged he made unwanted advances to other David Jones employees and that the company fostered a culture of sexual harassment by ignoring certain behaviour.

Ms Fraser-Kirk at times appeared close to cracking under the strain of scrutiny, including early yesterday when she emerged during a break in the talks.

Mr McInnes resigned in June after admitting ''serious errors of judgment'' in his actions towards Ms Fraser-Kirk. But he has strongly denied most of her allegations against him.
