AFTER more than a month of extreme stockmarket volatility, the shadowy figures engaged in aggressive short-selling have been warned by two market regulators they have legal obligations to disclose their activities.

But apart from warning hedge funds, the Australian Securities Exchange and the Australian Securities and Investments Commission extended the duties of disclosure about short-selling to brokers as well, after a widespread outcry about the lack of transparency surrounding it.

The commission also warned that individuals found to have spread false or misleading rumours - a practice dubbed "rumourtrage" among the US hedge-fund industry - faced a jail term of up to five years and a fine of up to $220,000.

The penalties are available under existing laws that ban market manipulation, false trading and market rigging.
