| NSW judges are among the privileged few allowed to top up their super beyond the government's new limits this year.
While most Australians will be restricted to concessionally taxed contributions of $25,000 if they are under 50 and $50,000 if older, a select group of state government employees are protected from these measures.
They are members of ''constitutionally protected super funds'' - a rare beast that the federal government cannot tax under the constitution because it would amount to taxing state assets.
Some members of these funds have also got out of paying the old superannuation surcharge for higher income earners.
