Selling the wrong toy at a yard sale could lead to a fine of up to $15 million under a new government policy, Fox News reports. The Consumer Product Safety Commission's "Resale Round-Up" aims to stamp out the sale of used toys that have been recalled due to high lead levels or other safety concerns. Second-hand stores, jumble sales, and individuals selling used goods are expected to consult the CPSC's list of recalled toys.

The CPSC says the fines—$100,000 per infraction, and up to $15 million for a series of infractions—are aimed at large companies, although sale organizers worry individuals will be targeted. "Most people having garage sales at this point don't have much anyway, so to have a fine levied against them is tantamount to harassment," a Fox legal analyst says. "And if you or I asked 100 people about this, they would never even know the law exists."

see. if this were done right. they would confiscate each toy and charge the exporting nation who originally made the toy a larger fine.


The reseller would just be given a small fine (too make them look at the listed of outlawed toys only) with a warning first perhaps?

But what this policy would possibly accomplish is making individuals throw out toys out of fear, kind of like the govt. tried to do away with used cars.

Which would in turn promote the purchase of more new toys. And in turn the spending of more money and consumerism. Possibly increasing debt by a miniscule amount at least during christmas time as the cc cards are used to replace toys.

And in the end could be a added govt. instrument to increase consumer spending and help recover the debt based economy.


maybe. Probably will be a failed attempt for bau.

either way. the toys really should be off the market. Harmful objects to unknowing children.................well we should draw a line somewhere.

because one needs to take responsibility for their actions and their harm on others.
If i knowingly sold you a used car that was unsafe.
And i sold it at market value for a car in good condition.
And you had a accident due to the cars problems which i knew about and you didnt.
You are out not only the price you paid for the car, but also whatever injury you suffered.
So i accepted your money under false pretenses. Claiming the product was something other than it was.
And you not being as informed as i was. Were not really given a chance to decide the on the purchase freely.
far as "fair". i corrected that because fair isnt really the correct term.

If you deliberately misrepresented the state of the vehicle, you're engaged in fraud. Since fraud is a form of theft, I can now sue you for damages, fine.

However, if the car was defective, but you made no claims that it is safe and you sold it for the same price to me, then even if I had an accident, you are in the clear.

Since you didn't misrepresent deliberately. You only said: "Here's my car, I want XYZ dollars, take it or leave it." And so I took it. End of story...
