A Californian man has been indicted on federal charges of making child pornography with an Australian girl.

The grand jury indictment says 30-year-old Troy Nelson exchanged graphic images online with the girl, who was then 15. Prosecutors say he then went to Queensland late last year to live with the girl, who had turned 16.

Nelson's attorney, Caro Marks, says her client is engaged to marry the girl, with her parents' permission. The age of consent in Queensland is 16.

Marks also says the relationship grew from friendship to love online, with the graphic exchanges coming later.

Nelson was arrested when he returned to the United States on March 2. He could face 40 years in prison if convicted of sexual exploitation of a child.
