Tulsi Gabbard continues to be the most interesting Democrat candidate for President. While the thundering herds of Democrat candidates are mostly clumped at the far left with a few seeming to appeal to traditional Democrat values closer to the center, Tulsi seems to be embracing her inner Libertarian.

Here are her recent tweets:

[1/3] If the government can change the designation of @Wikileaks from being a news organization (Obama Admin’s designation of Wikileaks) to a hostile intelligence agency (Trump Admin’s designation), then…

[2/3] …any entity – online and offline – is in danger of being designated a ‘hostile intelligence service’ if they carry out investigative reporting that the US government or a particular administration considers to be hostile to itself. This will have a chilling…

[3/3] …effect on investigative reporting of powerful government agencies or officials, including the president, intel agencies, etc. This is a serious breach of our constitutional freedoms and every American – Democrat, Republican or Independent – must stand up against it.

I have several reactions to this:

1. It is refreshing that Tulsi at least sounds like she is supporting free speech rather than being for censorship in the guise of targeting “hate speech”.

2. It is a bit of projection on the part of many in the media to claim that Wikileaks is an agent against democracy even as those same media are quite selective about what news to suppress or fake news to publish in support of their political allies.

3. Wikileaks has damaged national security in at least some of its disclosures, but how is that distinguishable from the New York Times and the Washington Post?

4. Are our institutions any longer able to make balanced judgements about national security and transparency necessary to a functioning democracy, or is it all just political theater in service to a pursuit of power?

5. If Google, Twitter, Facebook etc. coordinate in service to “the greater good” will we ever know what we don’t know?

We used to find comfort (justified or not) in our courts. Now we see rampant judge shopping to get desired rulings on constitutional issues and a reluctant Chief Justice Roberts to assert the Supreme Court’s authority over the practice of issuing “national” injunctions. That, and the seeming interminable path to a definitive answer on important constitutional questions at a pace unable to keep up with the threats we are facing internally and externally.

So where are the guardrails of liberty?
