| THE Government agency responsible for a bungled rail upgrade that could have led to the electrocution of passengers at Lidcombe Station failed to formally report the incident to the transport safety regulator.
The Transport Infrastructure Development Corporation came under intense scrutiny this year after a damning safety investigation by RailCorp found a new substation at Lidcombe had not been properly insulated.
The Independent Transport Safety and Reliability Regulator said it "became aware" of the incident in May, 12 months after it occurred. The regulator revealed yesterday it began reviewing the RailCorp safety investigation report this month.
Under the Rail Safety Act, the corporation must report "any defect in the infrastructure of a railway that may adversely affect the safe carrying out of railway operations", including "defects in the electrical infrastructure or civil infrastructure". The corporation's spokesman, Peter Whelan, said the incident - which was picked up at the last minute by RailCorp staff - did not qualify as a "notifiable occurrence" because it did not "affect the safe carrying out of railway operations"
