| A family business with less than half a million dollars of annual turnover is as liable as a large corporation under workplace unfair dismissal laws, the Fair Work Commission has ruled.
"We might have to retire, it's just too much pain for no gain."
Marco and Ulrike Schmidt's business, Gardens of Italy, makes luxury garden ornaments in South Africa and retails them in Australia.
But in a decision as part of an unfair dismissal dispute, in which a former employee is suing the Schmidts for $20,000, the business is deemed not to meet the legal small business definition because it employs 21 staff at its Johannesburg production site.
"We do not even regard ourselves a small business but a bonsai business struggling to make ends meets on both sides, South Africa and here," Mrs Schmidt said.
"They haven't taken the Third World factor into consideration," Mr Schmidt said. "They have just translated one job in Australia to one job in South Africa but there are economic differences."
