With the recent and continuing hulabaloo over conflicts between antidiscrimination laws and freedom of religion, the charge inevitably arises that anyone who is opposed to, or even skeptical of, antidiscrimination laws that apply to private parties–which means most people who identify themselves as libertarians–is effectively not pro-liberty, but pro-discrimination. I therefore thought it was a good time to reprint my rebuttal of that argument from Cato Unbound, published in 2010, below.

David Friedman's brief explanation (FB post):

Consider a couple who are dating. The girl tells her boyfriend that she really likes him, he turns her on, but she won't sleep with him because premarital sex is against her religion.

By the same arguments used in other contexts, she is imposing her religion on him and should not be permitted to do so.

The general issue is whether transactions between two people, whether sale, hiring, sex, marriage, rental, ..., should occur if and only if both parties want them, or if they should also occur if one party wants them and the other cannot offer a reason to refuse that the authorities approve of.
