| Tamil asylum seekers sent to Nauru by the Australian government had only recently arrived in India and had no work, schooling or residency rights there, lawyers claim.
The Australian government secretly flew 157 asylum seekers, held on the high seas for three weeks, to Nauru on Friday night, after they refused to meet with Indian consular officials at the Curtin detention centre.
The group includes 50 children, whom Immigration Minister Scott Morrison said could have returned to India, where they had family and were attending school, under his "unique" offer.
But lawyers acting for the asylum seekers said some of the Tamils had fled Sri Lanka and arrived in India in recent months, and faced a "precarious existence" if returned.
At least four families had arrived in India in the past 15 months and been unable to "register", educate their children or work, while one individual had arrived six months ago. Others had returned to Sri Lanka from India, been tortured and fled to India again. |
