FUGITIVE conman Peter Foster had "thumbed his nose" at the Federal Court by failing to appear and he needed to be found and brought to justice, a judge said today.

Foster did not front the Federal Court today, as ordered, to show cause why his appeal against his October jail sentence for contempt should not be dismissed.

However late today Justice Dowsett put a stay on the Australian Competition and Consumer Commission's dismissal application, reserving his judgment until early next year.

Foster failed to appear in the court in September and on October 24, when he was sentenced to three years' jail, suspended after 18 months, for contempt.

He had been earlier found guilty of defying a court-ordered ban on him working in the weight-loss industry and there is now a warrant for his arrest.

"The only way we are going to be able to bring him to justice is if somebody finds him, " Justice Dowsett said today.
