| THE grocery wholesaler Metcash has accused the Australian Competition and Consumer Commission (ACCC) - and possibly its chairman, Graeme Samuel - of knowingly pursuing a Federal Court case on a false basis.
In court yesterday, Metcash asked the ACCC to abandon the court case and foreshadowed asking Justice Arthur Emmett next week to dismiss the trial if the commission does not accede to its request.
The company's barrister, Justin Gleeson, SC, also flagged asking Justice Emmett to order Mr Samuel to provide an affidavit explaining the commission's conduct.
The ACCC agreed to provide a series of internal documents to Metcash's solicitors today and to the court when the case resumes on Monday.
