The State of Texas says online retail giant Amazon.com owes it $269 million in uncollected sales tax revenue.

Amazon received the assessment from the state in September for uncollected taxes, interest and penalties for the period from December 2005 to December 2009, according to documents filed Friday with the federal Securities and Exchange Commission.

The Texas comptroller's office confirmed that it had sent the bill. Amazon said it planned to contest the assessment, which it said was "without merit."

Amazon, which is based in Seattle, has a distribution center in the Dallas suburb of Irving.

Because of that physical presence, Amazon is supposed to collect sales taxes on transactions in Texas, under a 1992 U.S. Supreme Court ruling. But the world's biggest online retailer has not done so in Texas.

Other companies with stores or other operations in Texas do collect tax on online sales, including Sears, J.C. Penney and Dell Inc.

If Texas prevails in the dispute, the sales tax from Amazon would be a small percentage of the state's tax revenue. Texas collected $19.6 billion in sales tax revenue in fiscal 2010, which ended on Aug. 31.

It would also mean thousands of Texans would have to start paying tax on the electronics, clothes and other items they buy from Amazon — just as they do when they go to the mall or local Walmart.
