| FOR the second time this year riot squad officers have been found to have acted unlawfully in arresting people in Sydney's Oxford Street after officers were recorded by security cameras using excessive force.
Last Monday magistrate Estelle Hawdon found that the arrest of former navy clearance diver David Bunker, early on October 5 last year, was unlawful.
Ms Hawdon had viewed nightclub security camera footage, tendered by Mr Bunker's counsel Winston Terracini, SC, and revealed three weeks ago by The Sun-Herald, that showed up to 14 officers pinning Mr Bunker to the ground and up to four officers kicking, kneeing and punching him.
Police alleged Mr Bunker assaulted a female officer on entering a crime scene after raising police tape, resisted arrest and assaulted police. But the camera footage showed the opposite, with the female officer raising the tape and lunging at Mr Bunker and his brother Peter, instigating a melee in which other officers rushed to her aid, securing Mr Bunker on the ground while another group of officers shoved Peter out of camera view.
