A libertarian advocacy group is calling on the Michigan Supreme Court to bar counties from keeping amounts above their tax liens when they foreclose on Wolverine State properties. Local governments gave dire warnings during oral arguments Nov. 7, saying that a ruling against the state’s current foreclose-and-keep-the-proceeds system could have massive downstream consequences, possibly forcing the state’s 83 counties to cough up more than $2 billion to classes of property owners suing them for excess equity above their tax debts.
