| Subject: Military judge refuses to toss Navy SEAL Edward Gallagher's war crimes case over misconduct claims Sun Jun 09, 2019 1:45 am | |
|
- A military judge refused to dismiss the case against Special Operations Chief Edward Gallagher, a decorated Navy SEAL charged with killing a wounded Islamic State prisoner in Iraq in 2017.
- Defense lawyers argued for the case to be dismissed after discovering prosecutors secretly tracked their emails without court approval.
- A military judge, however, did find meddling by prosecutors and investigators troubling enough to reduce the maximum penalty Gallagher could face if convicted of premeditated murder.
- Gallagher is scheduled to go to trial June 17 on murder and attempted murder charges.
