THE Australian Crime Commission's long investigation into alleged money laundering and tax evasion, including into companies linked to the entertainers Paul Hogan and John Cornell, received a boost yesterday.

A Federal Court judge dismissed a legal challenge by the Swiss accounting firm Strachans and a West Australian financier Greg Dunn to block the commission from seizing crucial documents held in Strachans' Geneva offices.

Strachans is at the centre of the commission's investigation, Operation Wickenby, into the firm's creation of personalised schemes to enable wealthy Australians to minimise or avoid paying tax.

In 2005 the federal attorney-general made a mutual assistance request to Swiss authorities to allow commission investigators to seize documents from Strachans.

The request stated the material would "assist in an investigation into a major tax fraud in Australia". Strachans and Mr Dunn claimed there were factual errors in the request, making the application unlawful. Justice Richard Tracey of the Victorian Federal Court said the request concerned allegations against Mr Dunn, whom the commission alleged had declared an income of only $30,000 for the 2002, 2003 and 2004 income tax years, while sending millions of dollars to overseas bank accounts during the same period.

The judge said the request involved a Sydney accountant and two prominent entertainment figures, "H" and "C". He added: "[TS] is an accountant and financial adviser. He is also a principal of the [S] group of companies located in Sydney, Australia. He has a number of clients who are very prominent in the film industry including [H] and [C], who he has been associated with since 1989. He also has clients who live in the United Kingdom and the United States of America who are prominent in the motion picture industry, namely [E] and [S]…"

The main allegations against H and C, the court heard, were that they and other Australians used companies, trusts and bank accounts administered by Strachans "to disguise their involvement in tax fraud schemes and money laundering".

The court heard that in February 2004, the hotel room of Philip Egglishaw, one of the principals of Strachans who was visiting clients in Australia, was raided and his laptop and documents seized by the commission.

Justice Tracey said: "From this, the ACC learnt that Strachans administers various companies, trusts and bank accounts based in foreign countries on behalf of, and for the benefit of, a number of Australian residents and their families."

The ACC claimed Strachans helped Australian residents to hide their substantial assets overseas in companies and trusts hidden behind a complex array of incorporated overseas entities.

Using Strachans' services, they could access their funds from anywhere in the world by using debit or credit cards linked to bank accounts set up by Strachans, the court heard.

Documents previously filed in actions concerning the ACC's inquiry have implicated companies linked to Hogan and "Strop" Cornell, and their financial adviser Tony Stewart.

Mr Stewart has denied any wrongdoing and Hogan and Cornell say they have paid their share of tax and acted honestly.
